Lease Dispute and Restructuring Group

Wilk Auslander has formed a multi-disciplinary practice group to address the many issues facing commercial landlords and tenants as a result of the economic disruption caused by the COVID-19 pandemic.

Landlords and tenants are increasingly being confronted with questions involving enforcement of rights and remedies under their leases, the impact of new executive orders and legislation, as well as operational issues.  There is a need to find creative business solutions to address the changed environment.  Wilk Auslander’s team is uniquely experienced and equipped to advise clients on how to address these problems and plan for the near and long-term future.  In addition to lease restructuring and litigation enforcement, the group will assist on related matters, including tax, bankruptcy and employment.

Specific recent representation has included:

  • Preparing, negotiating and revising relevant lease provisions.
  • Advice and litigation involving rent collection, eviction and other breach of lease claims.
  • Monitoring and interpreting new rent and health and safety laws and guidelines.
  • Creating strategies to address building operational issues and risks.
